What does the conveyancing process involve?
Conveyancing covers the legal transfer of a property from one owner to another. At Paragonia, this includes reviewing the sale and purchase agreement, conducting title searches, coordinating with the relevant land registry, handling loan documentation if applicable, and filing stamp duty on your behalf. We keep you informed at each stage.
How long does a property transaction typically take?
Under standard conditions, a residential conveyancing transaction in Malaysia takes between three and four months from the signing of the SPA. Commercial transactions or those involving leasehold land may take somewhat longer. We provide a realistic timeline at the outset so there are no surprises along the way.
What do I need to bring for will drafting?
For a first consultation, it is helpful to bring your MyKad or passport, a general list of assets (property, bank accounts, investments), the names of intended beneficiaries, and any particular wishes you have about distribution. Our solicitor will guide you through the specifics in a confidential and unhurried conversation.
Is a will legally valid without a lawyer?
Under Malaysian law, a will can be handwritten and self-executed provided it meets specific statutory requirements — two witnesses, correct signing, and testamentary capacity. However, even small errors in wording or execution can complicate the probate process for your beneficiaries. Having a solicitor involved provides clarity and peace of mind.
What qualifies as a commercial dispute?
Commercial disputes typically involve matters between businesses or within a business context — unpaid invoices, contract breaches, partnership disagreements, misrepresentation claims, and similar issues. If a dispute has been referred to the courts or is heading in that direction, we can review the matter and advise on the most constructive way forward.
How are legal fees calculated?
For conveyancing, fees follow the Solicitors Remuneration Order and are calculated as a percentage of the transaction value, starting from RM 2,500. Will drafting begins at RM 900 depending on complexity. Litigation is billed on a case-by-case basis from RM 4,200, with regular statements so you always know where you stand.
