These terms govern your use of the Paragonia website and set out the basis on which we provide legal services to our clients. Please read them carefully.
1. About Paragonia
Paragonia is a legal practice registered in Malaysia under the Legal Profession Act 1976 and subject to the rules and professional conduct requirements of the Malaysian Bar. Our office is located at 28 Jalan Tun Perak, 50050 Kuala Lumpur, Wilayah Persekutuan.
These terms apply to: (a) the use of our website at paragonias.info; and (b) the engagement of our legal services where a separate client engagement letter or fee agreement has been issued.
2. Use of This Website
2.1 Permitted Use
This website is provided for informational purposes. You may browse and use it for personal, non-commercial purposes. The content on this website does not constitute legal advice, and nothing on these pages creates a solicitor-client relationship.
2.2 Accuracy of Information
We make reasonable efforts to keep the content on this website accurate and current. However, legal information can change, and we do not warrant that any information on the website reflects the current state of the law. For advice specific to your circumstances, please contact us directly.
2.3 Prohibited Conduct
You must not use this website in a way that is unlawful, harmful, or disruptive, or in any manner that could damage the reputation of Paragonia or the Malaysian Bar. You must not attempt to gain unauthorised access to any part of our systems or infrastructure.
3. Legal Services Engagement
3.1 Engagement Letter
A solicitor-client relationship with Paragonia is only formed when we have issued you a written engagement letter or fee agreement, and you have confirmed your instruction in writing. Prior discussions, website enquiries, or telephone conversations do not by themselves create an engagement.
3.2 Scope of Services
The scope of services provided will be as set out in your engagement letter. We will advise you on matters within the scope of that instruction only. If your matter evolves in a way that requires work outside the original scope, we will discuss this with you before proceeding.
3.3 Fees and Billing
Our fees are as set out in the engagement letter. For matters subject to the Solicitors' Remuneration Order (such as conveyancing), fees are determined in accordance with that Order. For other matters, fees may be on a time-cost, fixed-fee, or agreed basis as specified. We will provide transparent billing and, where the matter is ongoing, regular updates on costs.
3.4 Client Obligations
To allow us to carry out your instruction effectively, we ask that you provide complete and accurate information relevant to your matter, respond to our communications in a timely manner, and inform us of any changes in your circumstances that may affect the matter.
3.5 Termination of Engagement
Either party may terminate the engagement on reasonable notice. If you wish to terminate, please inform us in writing. We will provide you with all documents held on your behalf and will advise you of any steps that should be taken before the transfer of your file. Fees are payable for work completed up to the point of termination.
4. Limitation of Liability
Paragonia's liability in connection with legal services is limited to matters arising directly from our negligence or breach of professional duty. We are not liable for loss arising from matters outside our control, including delays by courts, registries, or other government bodies, or changes in the law after the date of our advice.
Our liability in connection with the use of this website — including any inaccuracies in the content — is excluded to the maximum extent permitted by Malaysian law. We are not liable for any indirect or consequential loss arising from your use of the website.
5. Intellectual Property
All content on this website, including text, design, structure, and graphics, is owned by or licensed to Paragonia. You may not reproduce, copy, or distribute any part of this website without our prior written permission, except for your personal non-commercial use.
6. Anti-Money Laundering
As a legal practice, Paragonia is subject to obligations under the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLATFPUAA 2001). We are required to carry out client due diligence procedures, including identity verification, before we can act for you. We may be required to report certain transactions to the relevant authorities. These obligations are imposed by law and we are not able to waive them.
7. Professional Conduct
Our solicitors are members of the Malaysian Bar and are bound by the Legal Profession (Practice and Etiquette) Rules 1978 and the relevant practice directions issued from time to time. In the event of any conflict between these terms and our professional obligations, our professional obligations shall take precedence.
8. Governing Law and Jurisdiction
These terms are governed by the laws of Malaysia. Any dispute arising from these terms or from the provision of legal services by Paragonia shall be subject to the exclusive jurisdiction of the courts of Malaysia.
9. Changes to These Terms
We may update these terms from time to time. The current version will always be available on this website and is identified by the "Last updated" date at the top of this page. Continued use of the website after any update constitutes acceptance of the revised terms.
